Terms & Conditions – SMS

Effective Date: October 10, 2025

These SMS Terms & Conditions (“Terms”) govern your use of the SMS / text messaging service (the “Service” or “SMS Service”) provided by Pelham PLLC (“we,” “us,” “our,” “Pelham”). By opting in to receive SMS messages from Pelham, you agree to these Terms in addition to any other agreements or policies posted by Pelham (e.g. Privacy Policy). If you do not agree to these Terms, you should not opt in or otherwise receive SMS messages from us.


Definitions

“Subscriber” or “you” means a mobile user who opts in to receive SMS messages from Pelham.

“Opt-in” / “Subscribed” means you have expressly consented (as described below) to receive SMS messages.

“Promotional Messages” are SMS messages that promote services, offers, or marketing content.

“Transactional / Informational Messages” are messages that provide non-promotional information (appointment reminders, account notices, updates) connected to your relationship with Pelham.


Opt-In / Consent

You must explicitly opt in to receive SMS messages from Pelham (e.g. via a web form, text-to-join keyword, written or verbal consent). Before sending you promotional SMS messages, Pelham will obtain express written consent (as required under applicable law, such as the TCPA in the U.S.). At the time of opt-in, you must be informed of:

  • The identity of Pelham PLLC (our name)
  • The types of messages you may receive (promotional, reminders, etc.)
  • The expected message frequency (or that frequency may vary)
  • That message & data rates may apply (by your carrier)
  • The fact that consent is not a condition of purchase (if applicable)
  • That you may opt out (instructions to opt out)
  • A link to these Terms and to our Privacy Policy

We will retain records of opt-in (timestamp, IP, method) to demonstrate compliance.


Message Types & Content

  • Promotional Messages: You may receive marketing or promotional content about Pelham’s services, offers, news, or events.
  • Transactional / Informational Messages: You may receive appointment reminders, confirmations, updates, billing or policy notices, or other non-promotional content.

Message Content

We will not send you content outside the scope of what was disclosed to you at opt-in (i.e. we won’t send unannounced message types).


Message Frequency & Timing

The number of messages you receive may vary, depending on your interactions with us (e.g. number of appointments, promotions). We will only send messages during times permitted by applicable laws and best practices (e.g. in the U.S., typically between 8:00 AM and 9:00 PM local time) to respect “quiet hours.”  We reserve the right to reduce or limit frequency if needed (e.g. for overload or compliance).


Carrier Fees & Cost

Pelham does not charge you for receiving SMS messages. However, your wireless carrier’s standard message and data rates may apply, according to your plan. You are solely responsible for any fees your carrier imposes.


Opt-Out / Unsubscribe

You may unsubscribe from the SMS Service anytime. Methods include:

  • Replying “STOP”, “END”, “CANCEL”, “QUIT”, or “UNSUBSCRIBE” (or other approved keyword) to any Pelham SMS message.
  • Changing settings via our website or user account interface (if applicable).
  • Contacting Pelham via email or phone with an unsubscribe request.

After your opt-out, we may send a final confirmation message (“You have unsubscribed…”) but no further messages, except as legally permitted (e.g. transactional notices). If you opt out, we will promptly (within a reasonable time) remove you from further marketing SMS messages.


Privacy & Data Use

Your phone number and related opt-in status will be handled under Pelham’s Privacy Policy. We may use third-party SMS delivery or management providers to send and log messages. We do not sell your phone number to third parties for marketing. We may use aggregated or anonymized data from SMS interactions for analytics.


Modifications & Updates

We may amend these Terms from time to time. The “Effective Date” at the top will reflect the current version. When we make substantial changes, we will notify you (e.g. via SMS or email) in advance. Continued use of the SMS Service following updates constitutes acceptance of the revised Terms.


Disclaimers & Limitations of Liability

Pelham makes no guarantees regarding message delivery, timeliness, or content accuracy (carrier networks and third-party providers may influence delivery). To the maximum extent permitted by law, Pelham and its service providers are not liable for any indirect, incidental, or consequential damages arising from the SMS Service. Pelham is not responsible for any carrier delays, failures, or interruptions.
